General Terms and Conditions of Hotel Stadt Pasing, Munich

Provision
Reserved rooms are available to the guest from 2:00 pm. Unless a later arrival time has been expressly agreed, the hotelier reserves the right to assign ordered rooms elsewhere after 6 pm.The guest does not acquire the right to provision of certain rooms or premises (event). If agreed premises are not available, the hotelier is obliged to seek equivalent replacement in the home or in other properties.

Repeat and unsubscribe
Logis (up to 4 rooms: individual guest):
Booked rooms can be canceled in written form one day before arrival until 6:00 pm, after which 80% cancellation fee will be charged to the lodges. Cancellations can generally only be made in writing no later than 14 days in advance, within 14 days before arrival, free of charge, after which 80% cancellation fee will apply to the lodges.

Logis from 5 - 10 rooms:
at low load:
up to 7 days before arrival free of charge
up to 3 days before arrival 50% on the lodgings
under 3 days before arrival 80% on the Logis


at high load:
up to 14 days before arrival free of charge
up to 10 days before arrival 25% on the lodging
up to 7 days before arrival 50% on the lodging
under 7 days before arrival 80% on the Logis

Logis (from 10 rooms: group arrangement):
For contingents of more than 10 persons (group arrangement), the following cancellation and reassignment periods apply:

28 days before arrival = complete cancellation possible free of charge
28 - 22 days before arrival = 25% on the agreed nights of accommodation
21 - 15 days before arrival = 50% on the agreed night of accommodation
14 - 8 days before arrival = 75% on the agreed overnight stays
7 - 0 days before arrival = 80% on the agreed night of accommodation

If the agreed quota covers more than 200 nights of accommodation, the abovementioned periods shall be extended by 30 days.

Logis (from 20 rooms: group arrangement):
For contingents of more than 20 persons (group arrangement), the following cancellation and reassignment periods apply:

42 days before arrival = complete cancellation possible free of charge
42 - 36 days before arrival = 15% on the agreed night of accommodation
35 - 29 days before arrival = 25% on the agreed night of accommodation
28 - 22 days before arrival = 50% on the agreed night of accommodation
21 - 8 days before arrival = 75% on the agreed night of accommodation
7 - 0 days before arrival = 80% on the agreed night of accommodation

If the agreed quota covers more than 200 nights of accommodation, the abovementioned periods shall be extended by 30 days.

Events
For agreed events and the provision of premises the following change and cancellation deadlines are valid:

20 - 50 participants (rooms up to 100 square meters) = 2 weeks
up to 100 participants (rooms up to 200 sqm) = 4 weeks

If the specified deadlines are not met, the contracting party is fully liable for the agreed services. The liability decreases with unclaimed Logis to a cost savings of 20%. On consumption agreements, a cost saving of 40% is granted up to 48 hours before the start of the event, however, the minimum room rent of the agreed premises is calculated to a minimum. In principle, the hotelier will endeavor to remunerate services that have not been used, whereby the liability of the contracting party is reduced by the proceeds received.

Organizers are requested to provide participant lists up to 48 hours prior to arrival as otherwise the hotel can not guarantee that it will proceed properly. The same applies to a larger than the agreed number of participants.

Deposit
If advance payments requested by the hotel are not made on the requested date (if no deadline is specified - no later than 30 days before arrival), this shall release the hotelier directly from any agreements made. The security provided by a valid credit card (card number and expiry date) replaces the prepayment obligation.

Commitment of offers
The excellent prices are inclusive prices and include service and sales tax (VAT). For trade fairs and Oktoberfest times, double rooms can also be used for single occupancy only at double room prices. If the period between contract conclusion and service provision exceeds 180 days, the hotel reserves the right to make price changes without prior notice.

Changes to the proportionate VAT rate shall be borne by the client, regardless of the time of the conclusion of the contract.

All price awards and agreements are in euros. If foreign currencies are mentioned, then only for non-binding orientation on the basis of the exchange rate valid at the time of publication.

Payment
Guest bills are to be paid immediately cash net cash.

All guest accounts are payable weekly.

Invoicing
Invoices sent on the basis of a previous credit agreement are payable net within 14 days. Outstanding payments exceeding the payment term are subject to a default interest of 1% per month (per month).

The hotel is entitled to reject foreign currency, checks and credit cards.

The following credit cards are accepted: Visa, Mastercard. Travel vouchers (vouchers) are only accepted if there is a credit agreement with the company concerned or if corresponding advance payments have been made.

A refund by voucher legitimate and unused services to the guest is not possible.

Exclusion of third parties
Claims and rights arising from agreements made with the hotel may only be transferred to third parties with the consent of the hotelier.

Liability
The contractual partners of the hotel or the guest as such or as the host are liable to the hotelier in full for damages caused by themselves or their guests.

Any deviating use of the rooms provided to the guest entitles the hotel to the immediate termination of the contractual relationship, without this reducing the claim to the agreed fee.

If the hotelier is obstructed by force majeure or strike in the performance of his services, no liability can be derived from this. However, the hotelier is obligated to the client to seek the procurement of equivalent services elsewhere.

The hotel is liable to the guest in accordance with the provisions of the Civil Code (100 times the room price, maximum € 3,000.00). Liability of the hotel is excluded if the room or the containers in which the guest leaves items remain unlocked. For money and valuables is liable in accordance with § 701 BGB only up to the amount of € 800.00. Guests are asked to hand over valuables to the reception. Money is open against receipt to deposit.

Departure
The guest is requested to inform the reception about the departure by 10:00 o'clock at the latest. The departure should take place until 11:00 o'clock or else an agreement with the reception will be made.

Attribution
The use of the name of the company and connected operating parts in connection with advertising measures of the contracting party requires the written consent of the hotelier.

External services
On external services, which are mediated or charged by the hotel, a surcharge will be charged. However, there is no liability of the hotel for the services of third parties.

Wake-up calls
The hotel will endeavor to carry out wake-up calls with the utmost care. Claims for damages from omission are excluded.

Lost property
Items left over are only forwarded on request. The hotel is committed to a storage of 6 months. After this time the items will be handed over to the local lost property office, if there is any apparent value.

Post and consignments
Messages addressed to guests, mail and consignments are treated with care. The hotel will take over the storage, delivery and, if desired, the forwarding of the same. Liability for loss, delay or damage is excluded.

Transport
As part of its services, the hotel in certain cases, the free transport of people and luggage. The liability for personal injury and property damage is limited to the statutory motor vehicle liability insurance. For losses and delays a liability is completely excluded.

Jurisdiction
is Munich. Deviating terms and conditions of the customer are expressly excluded by the above conditions.

Final Provisions

Changes and additions to the conract, the acceptance of the appilication or these General Terms and Conditions should be in text form. Unilateral changes or additions are ineffective.

Place of fulfillment and payment as well as exclusive place of jurisdiction - also for check and bill of exchange disputes is in commercial traffic Munich. If the customer meets the requirements of § 38 paragraph 2 ZPO fulfilled and has no general jurisdiction domestically, is valid as jurisdiction Munich.

German law applies. The application of the UN Sales Convention is excluded.

In accordance with the legal obligation, the hotel points out that the European Union an online platform for out-of-court settlement of consumer disputes ("OSPlatform") has set up: http://ec.europa.eu/consumers/odr/.

However, the hotel does not participate in dispute settlement procedures before consumer arbitration boards.
